These Terms and Conditions (“Terms”) govern your access to and use of the SafePrequal website, prequalification services, communications, and related features (collectively, the “Services”).
By accessing or using SafePrequal.com, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you should not use the Services.
1. About SafePrequal.com
SafePrequal.com provides consumers personlized prequalification results based on their credit profile.
SafePrequal.com may use information you provide, together with credit-related information obtained with your authorization, to generate personalized prequalification results.
SafePrequal.com is not a bank or credit card issuer and does not make final credit approval or underwriting decisions.
2. No Guarantee of Approval
SafePrequal.com’s assessments and prequalification results are intended to help you understand potential credit options based on information available at the time of your submission.
A SafePrequal.com result does not constitute a guarantee of approval, extension of credit, credit limit, interest rate, or other product terms.
If you choose to apply for a credit product after using SafePrequal.com, the applicable provider establishes its own eligibility requirements and makes its own approval and underwriting decisions.
3. Credit Review and Authorization
Certain SafePrequal.com Services require you to authorize access to credit-related information.
When you provide the required authorization, SafePrequal.com may obtain credit information for the purposes described in the authorization presented to you and in our Privacy Policy.
SafePrequal.com may use a soft credit inquiry to evaluate your credit profile. A soft credit inquiry does not impact your credit score.
If you subsequently choose to apply for a credit product, the provider of that product may obtain additional information and may perform a hard credit inquiry, which may affect your credit score.
Your authorization for SafePrequal to review your credit information does not constitute an application for credit.
4. SafePrequal SMS Account Notification Program
SafePrequal.com offers an optional SMS notification program for consumers who submit a SafePrequal prequalification request.
Consumers may separately opt in to receive SMS notifications from SafePrequal.com by providing their mobile telephone number and affirmatively consenting to receive text messages from SafePrequal.
SafePrequal.com SMS messages are used to provide notifications regarding a consumer’s submitted SafePrequal.com request. Messages may include submission status notifications, notification that personalized SafePrequal.com results are available, and instructions or links for securely returning to SafePrequal.com to access those results.
Message frequency varies. Message and data rates may apply.
Consent to receive SMS messages is voluntary and is not a condition of using SafePrequal.com, submitting a prequalification request, applying for credit, or purchasing any product or service.
SMS consent applies only to communications from SafePrequal.com for the messaging program to which the consumer has opted in.
5. How to Opt Out of SMS Messages
You may opt out of SafePrequal.com SMS messages at any time by replying STOP to a SafePrequal.com text message.
After you opt out, you may receive a final confirmation message confirming your opt-out request. You will not receive additional messages from the SafePrequal.com SMS program unless you subsequently opt in again.
6. SMS Help and Support
For assistance with SafePrequal SMS messages, reply HELP to a SafePrequal.com text message or contact us using the information provided below.
7. SMS Privacy
Your privacy is important to SafePrequal.com.
Mobile information, including your mobile telephone number, SMS opt-in data, and SMS consent, will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.
Mobile information may be disclosed to service providers that perform services on behalf of SafePrequal.com, such as telecommunications and messaging service providers, solely as necessary to provide and support the SafePrequal.com SMS program.
These service providers are not authorized to use your mobile information for their own marketing or promotional purposes.

8. SMS Delivery
Delivery of SMS messages is subject to effective transmission by your wireless carrier and other service providers and is not guaranteed.
Wireless carriers are not liable for delayed or undelivered messages.
Your wireless carrier’s message and data rates may apply.
9. Eligibility and Accurate Information
You must be at least 18 years old and legally capable of entering into agreements to use SafePrequal.com’s prequalification Services.
You agree to provide accurate, current, and complete information when using the Services and not to submit another person’s information without appropriate authorization.
You may not use SafePrequal for fraudulent, unlawful, deceptive, or unauthorized purposes.
10. Third-Party Services
SafePrequal.com may provide access to information, websites, products, or services provided by third parties.
SafePrequal.com does not control third-party underwriting decisions, eligibility requirements, approval decisions, rates, fees, terms, privacy practices, or websites.
If you choose to interact with a third-party provider, your interaction with that provider is subject to its own terms, disclosures, and privacy practices.
SafePrequal.com SMS consent is not transferred to third-party providers, and your consent to receive SMS messages from SafePrequal.com does not constitute consent to receive marketing or promotional SMS messages from any third party.
11. Electronic Communications
By using SafePrequal.com, you agree that certain communications and disclosures may be provided electronically, subject to applicable law and any consent requirements applicable to particular communications.
Consent to receive SMS notifications is separate from other authorizations or agreements and may be withdrawn at any time by replying STOP.
12. Disclaimer
To the extent permitted by applicable law, SafePrequal.com and its Services are provided on an “as is” and “as available” basis.
SafePrequal.com does not guarantee that its Services will always be available, uninterrupted, or error-free, or that you will qualify for or be approved for any particular credit product.
Nothing provided through SafePrequal constitutes legal, tax, or investment advice.
13. Limitation of Liability
To the fullest extent permitted by applicable law, SafePrequal and its owners, affiliates, officers, employees, agents, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Services.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
14. Changes to These Terms
We may update these Terms periodically to reflect changes to our Services, business practices, or legal requirements.
When these Terms are updated, we will revise the “Last Updated” date shown above.
Changes to these Terms do not override or replace any separate consent required for SMS communications.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law provides otherwise.
